Hit-and-run driver takes victim for ride

TEXAS — A 32-year-old man was killed early this morning when he was crossing the interstate on foot and a drunk driver hit him. The man’s limbs were severed and his body smashed through the car’s windshield and landed on the floor next to the driver, who just kept on driving.

After the collision, 45-year-old James John Onak exited the interstate and traveled a few more blocks. A deputy noticed him driving recklessly, so he pulled him over. As he approached the car, he noticed that it was badly damaged. The windshield was obliterated and the hood of the car was destroyed.

According to the deputy, Onak was so intoxicated that he didn’t know exactly what happened. He knew that he had hit something, but had NO IDEA that there was a limbless corpse lying next to him.

He was arrested and faces a felony charge of failure to stop and render aid, and a misdemeanor charge of tampering with evidence. DUI charges are also imminent, pending his blood test results.

The first two charges seem contradictory though because if Onak would have stopped and tried to give aid to the mangled victim’s body, that would also be tampering with evidence. Was he expected to try and reattached the victim’s limbs and keep pressure on his exposed brain until help arrived?

A normal, sober 32-year-old man should have had the ability to run across a road at night and NOT get hit by a car, so the victim is at least somewhat at fault for dashing to his own death. I think the best thing to do would be to charge Onak for the obvious crime of DUI and involuntary vehicular manslaughter.

If I saw a seriously injured person with their guts hanging out, I’d be too busy barfing everywhere to help, so I hope that doesn’t mean I’ll be charged with failure to render aid if I’m ever in that situation.
